Refund Policy
Section 1
Global Refund Policy
1.1 Unless required by applicable law, all purchases made at www.fitserver.it are non-refundable and non-exchangeable.
1.2 FitServer ShPK may issue refunds at its own discretion (see Section 7) or where the Customer exercises an applicable statutory right of withdrawal or refund (see Section 2).
1.3 Refunds will not be issued where there is evidence of fraud, refund abuse, or other manipulative behaviour.
1.4 This Policy does not affect consumer rights in relation to products or services that are not as described, faulty or not fit for purpose (see Section 4).
1.5 Refund requests must be made within the applicable statutory or discretionary period described in the sections below.
Section 2
Country-Specific Withdrawal Rights
2.1 Where local consumer protection laws grant unconditional withdrawal rights, those rights apply and override this Policy. Where regional differences apply within a given country, FitServer applies the highest standard of protection across that country.

Section 3
How to Request a Refund
3.1 To exercise the right of withdrawal or request a refund, the Customer may use one of the following channels:
- Use the "View receipt" or "Manage subscription" link in the purchase confirmation email;
- Submit a request through the support form available in the receipt or in the account billing page;
- Contact FitServer directly through the Contacts section of the website, selecting the "Abbonamenti, Pagamenti, Rimborsi (Subscriptions, Payments, Refunds)" option.
3.2 Approved refunds are processed, where possible, using the same payment method used for the purchase, within fourteen (14) days of approval of the request.
3.3 FitServer's transaction records will be used to verify eligibility and timing, without prejudice to the Customer's statutory rights.
3.4 If you are not sure about your purchase details or refund eligibility, please contact support via the Contacts section of the website.
3.5 If a transaction is not eligible for a refund, the Customer may still cancel the subscription at any time to prevent future charges. Cancellation will take effect at the end of the current billing period, in accordance with the Service Agreement.
Section 4
Refunds for Technical Defects or Product Issues
If the Customer experiences persistent technical issues or a material defect that prevents access to the features or benefits of the service as described, the following procedure should be followed:
- Contact FitServer as a first step through the Contacts section, describing the problem in detail and attaching any relevant screenshots or error logs;
- If the issue cannot be resolved within a reasonable time, submit a formal refund request setting out the problem experienced and the response received from support;
- Where there is evidence of a material technical or product defect, FitServer will issue a refund in accordance with applicable consumer protection laws.
Section 5
Add-Ons and One-Time Purchases
5.1 Add-ons linked to a main subscription expire automatically when the main subscription ends, unless otherwise expressly stated.
5.2 Refund eligibility for add-ons and one-time purchases (including the Software activation fee) follows the same criteria as the main purchase, unless local law provides otherwise.
5.3 Products or services that are delivered and made immediately accessible may be non-refundable once delivered, except where required by applicable law.
Section 6
Chargebacks and Payment Disputes
6.1 FitServer encourages the Customer to contact its support team before raising a chargeback or dispute with their bank, card issuer or payment provider. In most cases the issue can be resolved directly and more quickly.
6.2 If the Customer initiates a chargeback or payment reversal, access to the relevant service or product may be temporarily suspended for the duration of the review.
6.3 On receipt of a chargeback or dispute notification, FitServer will provide the payment provider with transaction details and, where relevant, documentation of the Customer's consent to waive statutory withdrawal rights.
6.4 This does not affect the Customer's lawful rights to dispute a charge under card-scheme or consumer protection rules.
Section 7
Discretionary Refunds
7.1 FitServer ShPK may, at its sole discretion, issue a refund if a request is submitted within fourteen (14) days of the purchase date. Submission of a request within this period does not guarantee a refund.
7.2 All refund requests are reviewed on a case-by-case basis. FitServer may consider relevant factors including the nature of the service or product, the reason for the request, usage or consumption, and applicable contractual terms. FitServer may approve a full refund, a partial refund, or decline the request.
7.3 Any discretionary refund granted by FitServer is voluntary and does not create an obligation to provide refunds in the future, including for similar requests. FitServer's decision to issue or not issue a discretionary refund does not waive any rights or remedies FitServer may have under applicable agreements or law.
Section 8
Updates to this Policy
8.1 FitServer ShPK may update this Policy from time to time. The updated version will be published on this page with the revision date.
8.2 The version of the Policy in effect at the time of purchase governs that transaction. We recommend saving or printing a copy of the Policy in force at the time of your purchase for your records.
Section 9
Governing Law and Disputes
This Policy is subject to the governing law, complaints and disputes provisions set out in the FitServer ShPK Service Agreement.
